Welcome to Find My Nursery, owned and operated by Find My Nursery (Pty) Ltd ("we," "our," or "us"). By accessing or using our website, services, or listings ("the Platform"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website.

2. Nature of service

Find My Nursery is an online directory platform that connects parents and guardians with nursery schools, preschools, and childcare providers across South Africa.

We provide listing and marketing services to registered nursery schools and childcare businesses. We are not a childcare provider and do not employ or endorse any listed nursery or individual unless explicitly stated.

3. Use of the platform

By using this website, you agree to:

• Provide accurate and current information when submitting a listing or enquiry.
• Use the website only for lawful purposes.
• Not upload, share, or publish misleading, false, or harmful content.
• Not attempt to damage, hack, or disrupt the functionality of the website.

We reserve the right to suspend or remove any user, listing, or business that violates these terms.

4. Listings and directory content

All listings are submitted by the nursery or organization itself. Find My Nursery is not responsible for verifying the accuracy of information provided by listed schools. Users are encouraged to verify information directly with the school before making enrolment decisions. Featured or Premium listings do not imply endorsement or quality assurance by Find My Nursery.

Where a listing includes photos or other media featuring children, the submitting nursery warrants that it has obtained the necessary parental or guardian consent for that imagery to be used on the listing and in related marketing. Find My Nursery relies on this warranty and does not independently verify consent for images supplied by a listed school.

5. Fees and payment

Basic listings are free of charge. Featured and Premium listings are paid services, offered either on a monthly or yearly basis. All fees are non-refundable unless otherwise agreed in writing. Prices are subject to change; any changes will be communicated to clients in advance. Payments are processed through PayFast, our approved third-party payment processor, or via the manual EFT option where offered — see our Privacy Policy for how payment data is handled.

Schools running a paid General Ad or Boost campaign on Find My Nursery must also follow our Ad Content & Boost Guidelines, which form part of these Terms and Conditions.

6. Website design and digital services

Find My Nursery also offers website design, hosting, and marketing packages to nursery schools. By purchasing these services, clients agree to:

• Pay the full quoted or package fee.
• Provide all necessary content (e.g., text, images, logos), and warrant that they hold any parental/guardian consent needed for photos or media featuring children supplied as part of that content.
• Grant permission for Find My Nursery to use logos or images for promotional purposes.
• Understand that website hosting, maintenance, and domain renewals are subject to separate fees.

7. Intellectual property

All content, design elements, graphics, and materials on Find My Nursery are the property of Find My Nursery (Pty) Ltd or its licensors and are protected under South African and international copyright laws. You may not copy, reproduce, or distribute any content from this website without prior written permission.

8. Third-party links

Our website may contain links to third-party sites or services. Find My Nursery is not responsible for the content, policies, or actions of any third-party websites. Users interact with such websites at their own risk.

9. Data collection and privacy

We collect and process limited personal information in accordance with the Protection of Personal Information Act (POPIA). Personal data may be used for communication, account management, and marketing (if consent is given). We do not sell or share user information with unauthorised third parties. We use analytics and advertising tools — including Google Analytics and the TikTok Pixel — to understand site usage and measure our marketing campaigns.

Because Find My Nursery is a childcare marketplace, some information we process relates to minors (for example, a child's age given as part of an enquiry or tour booking) — this is covered in full in our Privacy Policy, which explains exactly what we collect, why, and for how long, for every form on this site. Nursery-school clients should also see our owner privacy notice.

10. Reviews and ratings

Parents may submit reviews or feedback via QR codes or online forms. All reviews must be truthful, respectful, and based on genuine experiences. Find My Nursery reserves the right to remove or moderate reviews that are false, defamatory, or inappropriate. Please don't include a child's photo or other identifying information about a child in a review or review submission — reviews are moderated, but we may still remove or edit content that does.

11. Limitation of liability

Find My Nursery (Pty) Ltd and its directors, employees, or affiliates shall not be held liable for any loss, damage, or injury arising from:

• Incorrect or outdated listing information;
• User reliance on content provided by third parties;
• Technical issues, downtime, or service interruptions;
• Any direct, indirect, incidental, or consequential damages related to use of the platform.

Use of the website and its services is entirely at your own risk.

12. Indemnification

You agree to indemnify and hold harmless Find My Nursery (Pty) Ltd, its directors, and affiliates against any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, content submission, or violation of these Terms.

13. Suspension or termination

We reserve the right to suspend or permanently terminate access to the website or services at our sole discretion, without prior notice, if you breach these terms or engage in misuse of the platform. This includes, without limitation, non-payment of fees on a Featured or Premium listing (which may be downgraded or suspended until payment is resolved) and disputes over ownership of a listing raised through our claim-your-school process, pending resolution of that dispute.

14. Changes to terms

Find My Nursery (Pty) Ltd may update or modify these Terms and Conditions at any time. Updates will take effect immediately upon publication. Continued use of the platform after changes means you accept the new terms.

15. Governing law and complaints

These Terms are governed by the laws of the Republic of South Africa. If you have a complaint or dispute, please contact us first at admin@findmynursery.net so we can try to resolve it directly. If it isn't resolved that way, any dispute shall be handled in accordance with South African law in the courts of the Western Cape Province.
